Employment Rights Bill – Does it affect you?

Looking after your employees is paramount to a successful team and keeping in line with the law is vital. The government have been working on improving employment rights in the UK in what’s considered to be ‘the biggest upgrade in employment rights for a generation’.

 

A plan to ‘Make Work Pay’ is in the beginning stages of development with trade unions and businesses, and the ‘Employments Rights Bill’ is being implemented as phase one. Overall, the plan is aimed at supporting employees staying in work, improving living standards and growing the economy.

Will the new Bill affect you?

  • Bereavement leave will begin from day one with a right to unpaid leave, including pregnancy loss before 24 weeks.
  • Pregnant women will be protected from dismissal for a least six months after the return to work from Maternity Leave (except in specific circumstances).
  • Zero hours contracts are set to end with rights to guaranteed hours, notice for shifts, payments for cancelled shifts. These rights extend to agency workers.
  • Statutory Sick Pay will be strengthened by removing the Lower Earnings Limit and waiting period.
  • Employees will be protected against fire and rehire practices by removing the cap on tribunals or increasing the protective cap from 90 to 180 days.

Updates have been made last month and the final consultation will close on 15th January 2026 with measures being implemented in 2027.
